The website “HomeCareConnex.com” (hereinafter referred to as the “Site”) is owned by a private corporation duly incorporated in the Province of Ontario (hereinafter referred to as the “Company”). The Site has been uniquely designed to assist in streamlining the selection and hiring process for both employers of Personal Support Workers and/or Caregivers as well as those individuals providing Personal Support Work and/or Caregiving Services. The Site currently operates within Ontario and is governed by the laws of the Province of Ontario.
The Site should only be used for lawful purposes by individuals who are legally entitled to work in Canada and/or individuals or organizations who are legally entitled to employ workers in Canada.
Users of the Site must be 18 years of age or older and must have the legal capacity to enter into agreements of employment. The Company will not knowingly collect any information from individuals under the age of 18. In order to register for the Site, you must identify your age during the registration process. The Company does not assume any responsibility for any misrepresentations regarding your age when using the Site. Should the Company determine that you are under the age of 18, your registration will be terminated immediately.
“Affiliates” means subsidiaries, directors, officers, investors, assignees, agents, representatives, advertisers, website developers, marketing partners, licensors, independent contractors, recruiters, corporate partners, resellers, and/or employees of the Company.
“Company” means HomeCareConnex Inc., a private corporation duly incorporated in the Province of Ontario, carrying on business as “Home Care Connex” together with its affiliates, owners, partners, officers, agents, and employees.
“Content” means also “User Content” and is defined as any and all information and materials disclosed or uploaded, regardless of its language, content or form, including but not limited to, all data, images, photos, videos, audio, personally identifiable information, documents and any other information provided by or on behalf of a User or Registered User in connection with their use of the Site.
“Employee” means an individual who is seeking employment from an Employer.
“Employer” means one who has the capacity and authority to employ an Employee.
“Employment Relationship” means any relationship entered into, contemplated or discussed between Registered Users of the Site.
“Post” means any Content, as defined above, that is uploaded to or by any means placed on the Site.
“Registered User” means a person who has registered as a Registered User of the Site.
“Services” means any of the services provided by HomeCareConnex Inc whether by fax, telephone, email, Facebook, Twitter or any other media channels.
“Site” means the HomeCareConnex Inc website together with any affiliated websites, mobile websites, web pages, and mobile applications which may, from time to time, be managed and/or operated by HomeCareConnex Inc.
“Third Party” means any party other than the Company that may be hyper-linked to the Site or that may contribute to the Site and/or its Services.
“User” means a person who uses the Site without registering as a Registered User of the Site.
What We Don’t Do
The Company does not assume any liability that may result from any form of use of the information, Content, and/or Services provided on the Site.
The Company and the Site do not provide medical diagnoses, care or treatment.
The Company does not employ Personal Support Workers or Caregivers and it does not provide any references, endorsements or recommendations, nor is it responsible for the conduct of the Personal Support Workers or Caregivers using the Site. The Company not a recruitment agency or an employment agency.
The Company does not provide Workers’ Compensation or any other form of insurance to Users or Registered Users of the Site.
The Company is not responsible for screening or selecting any Employee on behalf of any Employer. It is the sole responsibility of every Employer to screen, select, interview, and hire any potential Employee and to comply with all applicable employment laws and standards.
The Company does not represent or warrant the age or legal status of any Registered User. It is the responsibility of every Employer to verify, among other things, that any potential or selected Employee is 18 years of age or older and legally eligible to work in Canada. Similarly, it is the responsibility of every Employee to verify, among other things, that any potential Employer is legally entitled to employ individuals in Canada.
The Company is not party to any Employment Relationship that results between Users of the Site. Any agreement between an Employer and an Employee, regardless of its nature, is strictly between the said Employer and Employee. All disputes regarding the delivery of service and/or conduct and/or payment due is to be directly resolved by the parties to the Employment Relationship. Furthermore, the Company will not be held responsible and disclaims any liability whatsoever for any claims, damages or demands of any type, whether direct or indirect, which may arise or is in any way connected with any dispute or disagreement between any Employer and Employee.
The Company does not perform background checks on Employees or Employers and does not verify any Content posted on the Site by any User or Registered User.
The Company does not assume any responsibility or provide any guarantee nor does it make any representations or warranties as to the reliability, quality or legality of the services that may be delivered by any Employer or Employee whether said Employment Relationship is entered into through the use of the Site or any other means.
The Company is not responsible for the conduct, whether online or offline, of any User or Registered User of the Site. Furthermore all Users and Registered Users, hereby agree not to hold the Company or any of its Affiliates liable for any actions or inactions of any User or Registered User of the Site, for any information, advice, instruction or services that were arranged through the Site, and, to the maximum extent permissible under applicable law, the Company and its Affiliates disclaim any liability whatsoever for any damages, suits, claims, and/or controversies that have arisen or that may arise, whether known or unknown.
Users and Registered Users of the Site assume all risks associated with the Employment Relationships created through use of the Site or any of its Affiliates or any Site operated by a Third Party.
Please be careful. There are inherent risks involved when using the internet, particularly when making employment decisions for persons in need of care. These risks include but are not limited to, fraud, negligence, theft, physical abuse, mental distress and, unfortunately, the risk of others taking advantage of you in a time of need.
Any information provided during registration must be current, accurate, and complete and it is your responsibility to ensure that such information is maintained and kept current during the course of your Subscription. You must use your legal name when registering as a Registered User of the Site and you must have the right and authority to post any and all Content that you choose to post about yourself or others.
All use, communications, activity, browsing, posting of Content, etc. involving your account is your responsibility. Your use of the Site must be in accordance with all applicable laws and regulations. You may not assign your responsibilities or account to any other person or company.
Any Content posted by any User, Registered User or Third Party is the responsibility of that User, Registered User or Third Party. For greater certainty, any information that was not provided directly by the Company to the Site is the sole responsibility of the provider of such information and content.
Posting or transmission of any Content deemed to contain or infer anything that may, in the absolute discretion of the Company, be considered illegal, abusive, violent, obscene, racially offensive, harassing, sexually orientated or in violation of another’s rights is not permitted and will be deleted without notice.
The Company does not endorse any representations or statements posted by Users and/or Registered Users of the Site.
The Company assumes no liability for any misrepresentations, misstatements, omissions, errors or inaccuracies made and/or posted on the Site by any User or Registered User and you hereby agree to indemnify and hold harmless the Company and its Affiliates for any misrepresentations, misstatements, omissions, errors or inaccuracies made and/or posted by any User or Registered User to the Site.
Payment and Refunds
You must pay a subscription fee to use the full features of the Site.
Users who wish to become Registered Users must register and agree to pay the Company all fees related to their choice of subscription as described on the Site.
Subscriptions will be automatically renewed upon expiry. You will be notified 30 days prior to the expiry of your Subscription and offered the option to renew.
The Site is available immediately upon completion of registration and payment and therefore no refund period is available. The Company may, in its sole and absolute discretion, issue a refund or credit if and when, in the opinion of the Company, such refund or credit is deemed to be warranted.
As permitted by all applicable laws, the Company is not liable for any act of others using the Site. We endeavour to provide a safe and secure area for our Users and Registered Users. However, we cannot guarantee the accuracy, security, or reliability of the Content provided.
All Users and Registered Users of the Site agree to hold harmless and indemnify the Company and its Affiliates from any claim arising from the use of any Content, as defined herein, which has been posted to the Site.
Any dispute arising out of the use of the Site shall be governed by the laws of the Province of Ontario without regard to its conflict of law provisions, and Users and Registered Users expressly agree and consent to the exclusive jurisdiction and venue of the Courts of Ontario for the resolution of any such dispute.
